피고인들은 2015. 10. 초순경 피고인 A의 친구 D을 통해 전화금융 사기( 일명 ‘ 보이스 피 싱’, 이하 ‘ 보이스 피 싱’ 이라고 함) 범죄조직의 일원인 성명 불상의 중국인 인출 총책을 소개 받고 그로부터 ‘ 타인의 현금 인출카드를 퀵 서비스 기사 등을 통해 수령한 후 이를 지시하는 장소에 갖다 놓는 일을 하면 10-15만 원의 수고비를 주겠다’ 는 제안을 받고 이를 승낙하여 위 중국인 인출 총책의 심부름을 함께 하기로 결의한 후 피고인 A은 스마트 폰에 설치된 모바일 채팅 앱 위 챗( 이하 ‘ 위 챗’ 이라고 함) 을 통해 중국인 인출 총책으로부터 미리 현금 인출카드가 배달될 장소를 연락 받아 피고인 B에게 이를 알리고, 피고인 B는 위 배달될 장소로 가서 현금 인출카드 5~6 장을 한꺼번에 수령하여 이를 다시 피고인 A에게 전달하고, 피고인 A은 위 현금 인출카드를 위 중국인 인출 총책이 지시하는 장소( 커피 숍 화장실 배전반 등 )에 갖다놓고 그곳에 미리 놓여 있던 담배 케이스에 담긴 수고비 명목의 현금을 수령하여 이를 피고인 B와 나누어 갖는 방법으로 그 때부터 현금 인출카드를 수령 후 전달하는 일을 반복적으로 해 온 사실이 있다.
