A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

The Defendant is a seller of used cars belonging to the C'D' company in Bupyeong-si, Busan.

1. Where a motor vehicle dealer who violates the Motor Vehicle Management Act places an advertisement on an Internet, he/she shall display the history of the motor vehicle and its seller information, etc., and shall not provide them in a false manner;

Nevertheless, on March 2018, the Defendant posted the “F”, not the actual seller, but the virtual personal seal, as a seller, at the Internet intermediate trading site (E), for an automobile sales advertisement stating that “E,” which is an online intermediate trading site, sold at KRW 5,700,000,000,” and provided false information on the seller of the automobile.

2. The Defendant, as if he/she placed an advertisement on the Internet used cars advertising site, did not possess a vehicle with a price lower than the market price, had the customer make a false advertisement as if he/she had such vehicle, and had the customer enter into the first contract on the relevant vehicle, and had the customer enter into the first contract on the vehicle, and had the customer make it impossible to cancel the contract because he/she did not give up the money already paid to the customer who demanded the cancellation of the contract.
