Defendant shall be punished by a fine of two million won.
If the defendant does not pay the above fine, KRW 100,000.
Reasons
Punishment of the crime
1. No motor vehicle dealer who violates the Motor Vehicle Management Act shall make any false or exaggerated indication or advertisement on a motor vehicle that intends to sell or arrange for sale or purchase;
Nevertheless, on June 20, 2016, the Defendant falsely indicated that the market price of 21:21,00,000 won was sold at KRW 4,50,000,000 for the food B-verification Co., Ltd. in 2016, and sent Kakao Stockholm messages to the victim C and posted them on the used cars sale site such as D.
Accordingly, the defendant committed an act of falsely indicating the vehicle price on the motor vehicle intended to be sold.
2. The Defendant attempted to commit fraud, despite the fact that the Defendant did not possess or are not a vehicle to be actually sold with E, intended to sell a used motor vehicle, which is a “fluort” and “fluort”, at a price lower than the market price, and solicited the Defendant to give up the contract by demanding additional expenses for the said motor vehicle, and to trade another motor vehicle with a large profit.
On June 19, 2016, the Defendant: (a) sold a sports vehicle to the victim C using telephone conversations and Kakakakaoth Messensenssenssenssenssenger in 2016, the 2016 Food B verification color Co., Ltd. (including registration fees); (b) on June 2016, E sold a sports vehicle to the victim via telephone communication with the victim “this vehicle for the purpose of trial use”; (c) as if the above amount was actually sold, the Defendant induced the victim to visit the Plaintiff to the Y-gu Seoul Special Metropolitan City, Nowon-gu, where the said trading company is located; and (d) on June 22, 2016, the Defendant displayed the sports vehicle in the H Trading complex located in Bupyeong-gu, Incheon, Incheon; and (e) drafted a sales contract on the said vehicle with the victim and the purchase price of KRW 4.5 million.
However, in fact, the market price of the above vehicle is at least 20 million won, and the defendant wishes to sell the above vehicle to 4.5 million won.
