A Imprisonment of one year and two months, Defendant B’s imprisonment of eight months, Defendant C’s imprisonment of six months, Defendant D and E, respectively.
Reasons
Punishment of the crime
1. No person, other than a marina society, shall commit any act similar to a horse riding voting in connection with racing conducted by a marina society to cause a person who violates the laws of the Republic of Korea (such as reburial, etc. of gambling) of Defendants A, B, and C to pay property or financial gains to the enemy;
Nevertheless, Defendant A and Defendant B, from May 29, 2015 to July 2, 2017, received the right of management of Cheongju-si Ma and 704,000 won per month from Cheongju-si Ma-si Ma and 204, recruited its members and provided them with cyber money equivalent to the total amount of money deposited to each member by receiving KRW 2,318,186,821 in sum from Defendant A’s Saemaul Cooperative Account (P) in the name of Defendant A, and provided them with the same amount of money deposited to each member, after paying dividends according to the ratio of dividend in the event that they carried on the betting, and if they did not participate in the betting, they operated the horse racing in the manner of holding the betting amount.
Defendant
C From the beginning of November 2016 to April 29, 2017, from Cheongju-si, Q 2 Rho-si: (a) recruited its members with a ID granted from Defendant A, and (b) received cash from its members; and (c) operated a private horse race track by allowing its members to engage in horse gambling as above by using a computer installed in the said private horse site by using a computer located in the country where the Defendant was granted, and (d) around April 29, 2017, members received a total of 55,00 won for a total of 104 occasions and carried out horse gambling.
As a result, the Defendants conspired to commit an act similar to the horse riding voting in relation to the racing conducted by a marina society, thereby paying property or property benefits to the enemy.
