Reasons
Punishment of the crime
1. No person, other than a Korean marina society, shall commit any act similar to riding voting in connection with a racing conducted by a marina society to allow anyone to commit any act in return for property or property benefits to the enemy;
Nevertheless, the Defendant, along with D, tried to operate a private horse race track by using the Internet horse racing site, recruited members who are engaged in gambling by obtaining the right to access the private horse manager's site from D, displayed the racing that was held in the actual horse race track to the members through the private horse racing site, and paid the dividend to the betting members according to the result of the competition.
Accordingly, from October 2015 to March 12, 2016, the Defendant established three computers in Gwangju Mine-gu E Building 510, the Defendant recruited members who are allowed to access the site manager’s website by obtaining a ID and password from D operating the “F,” and provided them with cyber money equivalent to 115,450,080 won in total over 143 times, as shown in the list of crimes in the attached Table, and provided them with a betting amount. From March 12, 2016, the Defendant predicted the result of the horse society’s racing which relays real time to each member, and, after the completion of the racing, the Defendant paid dividends in accordance with the dividend rate, and the Defendant did not operate the betting amount by 10% if he did not have a betting amount.
As a result, the Defendant, in collusion with D, caused persons participating in horse racing conducted by Morse society to engage in any act similar to horse riding voting, thereby paying property or property benefits to the enemy.
2. Any person who violates the Acts of marina society in Korea shall be held by a marina society;
