A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date of the final judgment.

Criminal facts

On February 4, 2014, the Defendant was issued a summary order of a fine of KRW 3 million for the violation of the Road Traffic Act in the Gwangju District Court's net support.

1. 특수협박 피고인은 2020. 2. 1. 19:20경 광양시 B에 있는 ‘C’ 앞 노상에서, 피고인의 D 카니발 차량 뒤에 E 쏘나타 차량을 주차하는 피해자 F(여, 50세)에게 다가가 “이런 씨발!”이라고 욕설을 하면서 피해자의 위 쏘나타 차량 앞문, 뒷문을 열었다가 닫고, 계속하여 “씨발! 너 가만히 있어! 내가 후진해서 니 차 콱 박아분다!”라고 말하며 위험한 물건인 위 피고인의 차량을 급후진하여 피해자의 위 쏘나타 차량을 들이받을 듯이 위협하였다.

As such, the Defendant carried dangerous objects and threatened the victim.

2. The Defendant was driving the said car in the state of alcohol concentration of 0.064% at the time and place specified in paragraph (1) of the Road Traffic Act.

3. On February 1, 2020, the Defendant: (a) at the place indicated in the foregoing paragraph (1) around 19:54 on February 1, 2020; (b) at the G District of the Mineyang Police Station G District where a traffic accident suspected of drunk driving was reported and 112 was demanded by H to measure alcohol; (c) “I am hump first hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum hum mal the Defendant’s cell phone

As such, the Defendant interfered with the legitimate performance of duties by police officers concerning handling reports, and at the same time inflicted injury on the victim.
