A defendant shall be punished by imprisonment for one year.
However, the execution of the above imprisonment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On April 25, 2012, the Defendant was sentenced to a suspended sentence of three years and a fine of eight million won in imprisonment with prison labor for a violation of the Customs Act at the Incheon District Court on April 25, 2012, and the judgment became final and conclusive on May 3, 2012.
1. Around March 17, 2010, the Defendant forged official document forgery or forged official document display without authority at the F office located in Seo-gu Incheon, Seo-gu, Incheon with the aim of exercising authority. Without authority, the Defendant added the content of “AVNE 2001 H, OPIMA 2001 J, LOTE 2008K” in the part of “I” in the export declaration number GG 2001 issued by the head of the Incheon Customs office, “SM5201 H,OPIMA 2001, LOTE 208K,” and copied it with the copy as if the export declaration certificate was issued, thereby forging one export declaration certificate issued in the name of the head of the Incheon Customs office, which is an official document, and from around that time, from around 2017 to 317, the Defendant used the above copy of the export declaration certificate in the name of the employee under the name of the head of the Incheon Customs office.
2. The Defendant in violation of the Customs Act purchased and exported a car that is actually unable to trade in a normal condition due to its registration of seizure, and at the same time, submitted a false export declaration as if it were exported of a normal car that has no such restriction.
In collusion with L, the Defendant reported different goods to L with L, thereby supplying large-sized vehicles, and the Defendant for smuggling exports a passenger vehicle to the Incheon port by using the export declaration certificate (reporting number G) after completing the export declaration on the eM5 vehicle of the chassis number H around March 20, 2010.
