A shall be punished by imprisonment with prison labor for ten months, and imprisonment with prison labor for six months.
However, this judgment is delivered against Defendant B.
Reasons
Punishment of the crime
When it is intended to export goods, the name, standard, quantity and price of the relevant goods and other matters prescribed by Presidential Decree shall be reported to the head of the relevant customs office, and no goods shall be exported after filing a declaration thereon.
Nevertheless, the Defendants conspired to operate F and G companies established for the purpose of automobile export business, etc. in Seo-gu Incheon Metropolitan City, and the Defendant A is in charge of purchasing and operating cars, Defendant B is in charge of fund management and automobile export-related business, and upon receipt of an export declaration certificate issued by customs office, expressed that the vehicle was closely exported in a foreign country by altering the chassis number stated in the column of the export declaration certificate to the chassis number of the vehicle to be exported actually.
1. The Defendants in violation of the Customs Act conspired to export one motor vehicle at the Incheon port located in Jung-gu Incheon, Jung-gu, Incheon, which was declared to export the export declaration number H class III high 2009 model (Motor vehicle No. 1): but actually exported the amount equivalent to KRW 17,454,00 from May 1, 2009 to June 18, 201, as indicated in the attached Table 40 times in total, the amount of KRW 706,797,519 at the market price of the 2009 model (J. 17,519), including the smuggling of the other motor vehicle reported to the customs office by loading the amount equivalent to KRW 17,454,00.
2. On April 2009, the Defendants conspired to alter official documents and display altered official documents in collusion, and without authority to exercise them at the F Office of the F Office of the foregoing corporation, the name of the head of the Incheon Headquarters, which is the official document, in the name of the head of the Incheon Headquarters, by printing out the chassis number of "L" in the same size as the characters written in the "design and Specifications" column of the original export declaration certificate, which is the same as the size written in the name of the head of the Incheon Headquarters.
