A defendant shall be punished by imprisonment for six months.

Punishment of the crime

1. On August 9, 2016, the Defendant, while working as an employee of convenience stores operated by Gangnam-si, who settled cash goods, made a ruling system by means of a credit card or other means of payment, and made a cash refund to customers, using the following: (a) the receipt for the goods settled in cash is returned when they request the change of the means of payment, and (b) the cash was returned to the convenience store business owner; (c) the Defendant arbitrarily disposed of the receipt for cash payment and made a ruling with a stolen credit card; and (d) without being released to the convenience store business owner.

B. On August 9, 2016, at around 04:55, the Defendant violated the Specialized Credit Financial Business Act (hereinafter “Specialized Credit Financial Business Act”) on August 9, 2016, around 04:55, the Defendant settled the receipts equivalent to KRW 29,600, and the receipts equivalent to KRW 18,000, each of which was stolen as described in the above paragraph (a), on three occasions, at the above convenience store, by paying refund to customers in cash.

Accordingly, the Defendant used stolen credit cards.

C. On August 9, 2016, the thief Defendant, at the convenience store around 05:05 on August 9, 2016, was stolen by taking 47,600 won in cash owned by the victim D, which was kept in the POS machine, from around 05:05 on August 9, 2016.

2. The crime committed on August 13, 2016;

A. A thief: (a) around August 13, 2016, at the places indicated in the foregoing paragraph (1) on August 13, 2016, the Defendant stolen property worth KRW 1,185,600 in total, including the victim D cash amounting to KRW 510,000, KRW 199,600, KRW 300, KRW 100,000, KRW 11,000, KRW 11,000, KRW 12, KRW 6,000, and KRW 1,185,60.

B. The Defendant’s fraud by using computers, etc. is the date, time, and place mentioned in the above two paragraphs (a).
