Reasons
1. Details of ruling;
(a) Project approval and the name of the public announcement project: An urban planning facility project (B) project implementer (C) (hereinafter referred to as the “instant project”): The public announcement by the Defendant on December 15, 2016; D
B. In order to purchase land and obstacles owned by the Plaintiff by the Plaintiff according to the instant project, the Defendant, who failed to obtain a consultation, requested an appraisal business entity to conduct an appraisal by 2 appraisal business entities (Seoul Appraisal Corporation and Central Appraisal Corporation). On March 6, 2017, the said appraisal business entity as of March 6, 2017, as of the land and obstacles owned by the Plaintiff, shall be as follows:
As described in paragraph (1), an appraisal (hereinafter referred to as "appraisal of acquisition by consultation") was made.
C. The subject matter of expropriation made on July 20, 2017 by the Governor of the Jeollabuk-do Regional Land Expropriation Committee: The subject matter of expropriation was divided into 75 square meters in Yansan-gu, Seoul Special Metropolitan City (hereinafter “instant land”) and 14 square meters in F large 4 square meters (hereinafter “instant land”) and f large 4 square meters in Yan-gu, Seoul Special Metropolitan City, Seoul Special Metropolitan City, the Plaintiff-owned, into Masan-si, and 143 square meters in Mansan-gu, G large 139 square meters in Ga-gu, G large 139 square meters on May 2, 2016.
On September 12, 2017, each ground house and obstacles (hereinafter referred to as “instant obstacles”): The appraisal results (the numerical mean of the new appraisal corporations in the future of the stock company and the appraisal appraisal corporations and the appraisal appraisal corporations substituted by the appraisal appraisal corporations): 57,88,750 won for the instant land at the time of pricing on July 20, 2017; 3,041,60 won for the instant land; 76,360,960 won for the instant obstacles; and 137,291,310 won for the instant obstacles (hereinafter referred to as “appraisal of expropriation”): The appraisal of the instant land at the time of pricing (hereinafter referred to as “appraisal of expropriation”).
D. As a result of the appraisal by the Central Land Expropriation Committee on November 23, 2017 (the arithmetic mean of the appraisal corporations and the Pacific Appraisal Corporation): 60,300,000 won for the land of this case at the time of pricing on July 20, 2017; 3,152,800 won for the land of this case; and 3,152,800 won for the land of this case at the time of pricing.
