A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Point of interference with business;

A. On November 21, 2012, at the early 21:30, the Defendant: (a) stated that “Ecafeteria” operated by the victim D (hereinafter referred to as the “Ecafeteria”) in Ycheon-gun, Gangwon-do, would have ever taken a large amount of alcohol without drinking it; (b) stated that the victim would have taken a large amount of alcohol; and (c) carried 30 prone bottles accumulated in the front, she interfered with the victim’s restaurant business by force by preventing the victim from carrying out the restaurant business for about 30 minutes; and (d) she laid down 30 minutes of the empty-bes accumulated in the front, thereby obstructing the victim’s restaurant business by force.

나. 피고인은 2012. 12. 중순 21:30경 F에 있는 피해자 G(여, 72세)가 운영하는 ‘H 피시방’에서 피고인이 ‘이런 씨팔, 이런 씨팔’이라고 큰소리로 떠들어 피해자가 ‘손님에게 방해되니 이제 집에 가라’고 한다는 이유로 그곳에 있는 카운터 책상을 잡아 흔들고 위 게임방 이곳 저곳을 돌아다니며 바닥에 뒹구는 등 약 30분간 소란을 피워 피해자가 PC방 영업을 하지 못하게 함으로써 위력으로 피해자의 PC방 영업 업무를 방해하였다.

C. At around 17:00 on June 3, 2013, the Defendant opened a cooling door at the above Ecafeteria without any justifiable reason.

닫았다를 수차례 반복하며 가게 내부를 두리번거리고 바닥에 뒹구는 등 약 20분간 소란을 피워 피해자가 식당 영업을 하지 못하게 함으로써 위력으로 피해자의 식당영업 업무를 방해하였다.

2. Points of sentrys, violence; and

A. On March 18, 2013, at around 00:50 on March 18, 2013, the Defendant: (a) stated that I (Nam and 20 years of age) who was a soldier belonging to the Headquarters, who was on the duty of guard in the documents in the Hacheon-gun, Seocheon-do, Seocheon-do, Seocheon-do, the military court: (b) stated I (Seoul and 20 years of age) that I want to enter the Defendant without permission to the Defendant’s ward; (c) stated I (d) that “this would not be done by the person who will do so,” and (d) stated I as follows: (e) he carried the said I on a ship and carried the chest by hand.
