A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2013. 11. 22. 18:45경 삼척시 C, 13-나동 34호에 있는 피해자 D(여, 62세)이 운영하는 “E식당”에서 친구인 F와 함께 술을 마시러 갔다가 다른 손님인 G와 F가 다투는 것을 말리는 과정에서 G가 뒤로 넘어지며 엉덩방아를 찧게 되었으며, 이를 목격한 피해자가 112신고하여 삼척경찰서 H파출소에서 조사를 받게 된 것에 대하여 불만을 품고 있었다.

1. At around 08:00 on November 23, 2013, the Defendant found the victim’s fighting and did not assault him/her to report to the police.
