A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Despite the fact that the Defendant is not a narcotics handler, the Defendant smoked, received, or avoided the hemp plant as follows:

1. On October 7, 2014, the Defendant, together with C, D, E, and F, smoked in F’s vehicle parked in H located in Gyeonggi-gu G, Gyeonggi-gu, with approximately 0.6g of tobacco smoke, added approximately 0.3g of tobacco to that vehicle, added a fire, and smoked by smoking in a way of smoking.

Accordingly, the Defendant conspiredd with the above C, etc. to smoke the hemp plant.

2. On January 1, 2017, the Defendant, along with D and E, smoked from the back seat of the 16th vehicle of the 16th vehicle owned by D, parked in H located in Pyeongtaek-gun G of Gyeonggi-gu, at the beginning of the first half of January 2017, after a deduction of approximately 0.8g of the hemp plant possessed by D from the beginning of the tobacco tobacco year, after being added to the plant, put the tobacco into the plant, put the cigarette into a smoking method.
