피고인은 2015. 9. 20. 14:00경 부산 동구 B 빌라 현관 입구에서, 피고인의 처의 가정폭력 신고를 받고 출동한 부산동부경찰서 C지구대 소속 경사 D, 순경 E이 피고인의 주거지인 501호에 들어가 신고경위를 확인하자, 부엌으로 가서 주방 집기를 신고자를 향해 던지고 와인 병을 깨뜨리는 등 행패를 부리고, 경찰관들이 2차 피해를 방지하기 위해 피고인을 제지하여 집 밖으로 데리고 나오자 빌라 정문 출입구 계단에서 “씨발 새끼야, 짭새 새끼야 가자, 파출소 가서 조사 받자.”라고 욕설을 하면서 오른쪽 다리로 피해자인 경사 D의 오른쪽 무릎을 1회 때리고, “개새끼야, 내가 너거들 다 죽인다.”라는 등으로 협박하여, 경찰관들의 112신고사건 처리에 관한 정당한 직무집행을 방해하였다.
