1. Details of the disposition;

A. On July 18, 2007, the Plaintiff entered the Republic of Korea on a short-term commercial status (C-2) sojourn status on July 18, 2007, and stayed after obtaining permission for change of sojourn status on October 15, 2007 (D-8).

On June 5, 2013, the Plaintiff was sentenced to a fine of KRW 3 million for the crime of forging private documents, uttering of perjury documents, obstruction of performance of official duties by fraudulent means, etc. at the Seoul Central District Court.

After that, the Plaintiff applied for the change of status of stay to trade management (D-9) status without a long-term expiration date of the period of stay ( August 28, 2013), but the change of status of stay was rejected on August 30, 2013 on the ground of the above conviction.

Accordingly, on February 26, 2014, before the expiration date of the departure grace period ( February 28, 2014), the Plaintiff stayed two times with the grace period of departure, and applied for refugee status to the Defendant.

B. On April 28, 2015, the Defendant rendered a decision to deny refugee status (hereinafter “instant disposition”) on the ground that the Plaintiff does not constitute a case where there is a well-founded fear that the Plaintiff would be subject to persecution” as prescribed by Article 1 of the Convention on the Status of Refugees and Article 1 of the Protocol Relating to the Status of Refugees.
