1. Details of the disposition;

A. On March 1, 1998, the Plaintiff was appointed as an associate professor or assistant professor of the Music University of the National University, and was appointed as an associate professor on October 1, 2001 and on October 1, 2006 as a professor.

B. On February 21, 2011, the president of B University requested the General Disciplinary Committee on Public Educational Officials of B University (hereinafter “Disciplinary Committee”) to impose heavy disciplinary and disciplinary charges on the Plaintiff pursuant to Article 78(1) of the State Public Officials Act. On February 28, 2011, the Disciplinary Committee decided to dismiss the Plaintiff and impose additional charges KRW 12 million on the ground that the Plaintiff violated Articles 56 (Duty of Fidelity), 61 (Duty of Integrity), and 63 (Duty of Integrity) of the State Public Officials Act.

C. On March 10, 201, the president of B University removed the Plaintiff from office (hereinafter “instant disposition of removal”) in accordance with the above disciplinary resolution, and imposed the Plaintiff surcharges of KRW 12 million (hereinafter “instant disposition of disciplinary surcharge”). The president of B University rendered a disposition of imposing disciplinary surcharge of KRW 12 million (hereinafter “instant disposition of dismissal,” and “instant disposition” in addition to “disposition of removal” and “the Plaintiff’s dismissal.”

On the other hand, the Disciplinary Committee and the Defendant were established on the basis of Article 3 of the Higher Education Act, and was established and managed by the Republic of Korea under the former Ordinance on the Establishment of B University repealed repealed by Presidential Decree No. 23116 on December 28, 201.
