1. On April 20, 2017, the Defendant imposed a reduction in salary and a surcharge of KRW 36,00,000 on the Plaintiff.
Reasons
1. Details of the disposition;
A. On January 1, 1995, the Plaintiff was appointed as a public college environmental engineering and instructor at B’s university university on January 1, 1995 and served as a professor in environmental energy engineering and regularly from April 1, 2007.
B. According to the request for disciplinary action made on May 12, 2015 by the Board of Audit and Inspection on April 20, 2017 and the decision to dismiss a retrial made on February 2, 2017, the Defendant deemed that the Plaintiff violated Articles 56 (Duty of Fidelity), 61 (Duty of Integrity) and 63 (Duty of Integrity) of the State Public Officials Act (amended by Act No. 10342, Jun. 8, 2010; hereinafter the same shall apply) as follows, the Defendant issued a disciplinary action against the Plaintiff following a resolution by the General Disciplinary Committee on Public Educational Officials at B University pursuant to Article 78 (1) 2 and 3 of the State Public Officials Act (hereinafter “instant disposition”).
From November 10, 2008 to October 17, 2014, the Plaintiff performed the task as a person in charge of the 19 service research tasks. Among them, 15 service tasks participated in the 15 staff members of the LAC, and the said employees received 272,865,884 won in total, in return for the performance of the above service tasks.
However, D, who is a director of the environmental business division of the Dispute Resolution C, received 184,618,923 won out of the personnel expenses received by employees as above from its own account and used it as the operating expenses of the company.
D As such, a part of the service research tasks for which the Plaintiff is responsible is an executive officer of a company to which he/she belongs.
Nevertheless, the Plaintiff received total of KRW 36,00,000 on March 29, 2010 from D, who is a person related to his/her duties, including KRW 4,000,000, KRW 6,000 on June 15, 2010, KRW 8,000 on March 10, 201, KRW 8,000,000 on March 15, 201, KRW 10,000 on January 26, 201, and KRW 36,00,000 on five occasions from March 29, 2012 to January 26, 2012.
C. The Plaintiff filed an appeal review with the Appeal Commission for Teachers, but the Appeal Commission for Teachers dismissed it on July 5, 2017.
