A defendant shall be punished by imprisonment for one year.

Punishment of the crime

The Defendant, from April 199 to December 2, 2013, is a person who has overall control over the business affairs of the Defendant while operating the CNC Line D Company in Kimhae-si, Kimhae-si.

1. Embezzlement;

A. On March 23, 2011, the Defendant entered into a lease agreement with the victim’s employees to lease two CNC lines equivalent to KRW 115,40,00 (lease principal) at the foregoing D Company’s office (hereinafter “victim Company”) and the victim’s market price at 115,40,000 (Lease principal) at the victim Company’s office, and used the said machinery by setting the lease fee of KRW 2,96,50,500 for 36 months.

On June 2012 or July 2012, the Defendant sold two of the above machinery owned by the victim company, which was kept in custody, to the victim with no name, at KRW 60 million, and embezzled it.

B. Around December 10, 2012, the Defendant: (a) entered into a lease agreement with the victim company’s two capitals (hereinafter “victim company”) at the above D company office; (b) one of the CNC lines at the market price of KRW 99,000,000 (lease principal) at the victim company; (c) one of the CNC lines at the lease price of KRW 2,067,210,210 (Lease principal); (d) the lease period of 48 months; and (d) around December 17, 2012 at the office of the above D company, one of the CNC lines at the market price of the victim company and the victim company’s market price of KRW 198,00,000 (Lease principal) at the above D company’s office; and (d) concluded the lease agreement with each of the above employees of the victim company; and (e) concluded the lease agreement with each of the above employees of the victim company.

On December 2, 2013, the Defendant sold the two machinery owned by the victim company, which was kept in custody, to the person who was not the victim's name, and embezzled it.

8. By around 30.30, the Bank of Korea of the Victims located in Kimhae-si (hereinafter referred to as the “victim bank”) obtains a loan of KRW 1.89 billion from the Victim bank at the center of Kimhae-si.
