Punishment of the crime
[2015No. 465] The Defendant is an operator of “D” for the purpose of manufacturing business, etc. in Changwon-si, Changwon-si C.
Around January 29, 2014, the Defendant entered into a lease agreement with the Victim Non-SP Capital (hereinafter “victim Non-SPPP”) on a deposit amounting to KRW 6.3 million, monthly rent of KRW 154,876 (one to three times), or KRW 656,578 (4 to 48 times), or the lease period of KRW 48 months. On April 16, 2014, the Defendant entered into a lease agreement between the Victim Non-SPPPPPP and the Victim Non-SPPPPP and the victim Non-SPPPPP and the amount equivalent to KRW 31.5 million at the market price of the victim Non-SPPPPPP (Article 3615842), between the victim Non-SPPPP and the victim Non-SPPPP and the victim KRW 3615762,384,484,784,784,794,7849,7.
Accordingly, the Defendant, upon delivery of the said two machines, embezzled the total amount of KRW 63,80,000,000 of the market price of the said two machines owned by the victim non-SP capital, on December 2014, when the Defendant kept the said two machines for the victim non-SP capital in custody in the said D, and sold the said machinery to a secondhand buyer, whose name is unknown in the said D and whose name is not known, in cash at KRW 35 million.
[2015No. 630] On September 5, 2013, the Defendant entered into a lease agreement with F, the representative of the E business office, and paid KRW 2.5 million as the down payment on the same day, and paid KRW 5 million as the intermediate payment on September 9, 2013, but the Defendant purchased the said machinery by concluding a lease agreement with F, the representative of the E business office (the model name HH-100).
The Defendant, around September 12, 2013, at D offices located in Changwon-si, Changwon-si G, the amount equivalent to KRW 27.5 million in advance to KRW 7.5 million in the market price of the said machinery between the lessee and the victim capital at D offices located in Changwon-si, Changwon-si, Changwon-si.
