Defendant shall be punished by a fine of 500,000 won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

[2016 High 1502] A person who intends to run a brokerage business shall register with the head of a Si/Gun/Gu having jurisdiction over an area where he/she intends to establish a brokerage office, and no person shall run a brokerage business without registering the establishment of a brokerage office.

Nevertheless, on October 27, 2014, the Defendant: (a) without registering the establishment of a brokerage office; (b) arranged to purchase “Tgu Nam-gu F” in the D Authorized Brokerage Office located in Daegu-gu, Daegu-gu, from the D Authorized Broker Office for purchase KRW 90 million; (c) received KRW 1.5 million from E as a brokerage fee around October 30, 2014; and (d) conducted brokerage business, such as arranging and receiving remuneration for the act of acquisition, loss, or acquisition of rights, such as the sale and purchase of real estate between the parties to the transaction of real estate, as described in the attached list of crimes, during the period from March 3, 2013 to February 2015.

[2016 High 1710] The Defendant is the chairperson of the Promotion Committee for the Establishment of the Partnership for the Development and Improvement of G Housing; the chairperson of the Promotion Committee or the project implementer shall make public the documents and related materials concerning the implementation of the rearrangement project, such as the Operational Rules of the Promotion Committee and the Articles of Incorporation concerning the Implementation of the Rearrangement Project, along with the Internet and other methods so that the owners or tenants, such as the members, the land, etc.

Nevertheless, even though the committee for promotion of the above G Housing Redevelopment Project was approved on November 4, 2014 by the committee for promotion of the redevelopment project, the Defendant concurrently runs the Internet and other methods, such as the committee for operation of the committee, the details of monthly entry and withdrawal of funds, the quarterly disbursement statement, the meeting minutes of the committee for promotion, the meeting minutes of the resident general meeting, the audit report, etc., around March 11, 2016, before establishing the HAC at the portal site.
