A Imprisonment for one year, and each of the defendants B shall be punished by imprisonment for eight months.
However, for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Defendant
A is a petroleum retailer operating "F gas station" in Jung-gu Incheon Metropolitan City, and Defendant B is an employee of the director's office in charge of the general affairs of the above F gas station.
The Defendants filed an application for a subsidy with the principal agent to pay as if the truck had paid a cargo welfare card from the principal agent of the cargo at the above principal agent station as if the truck had paid through the normal transit by means of manipulating transaction details, etc., and the truck drivers agreed to pay in the same manner to receive the subsidy, and the truck owners agreed to receive the subsidy, respectively.
In accordance with the above public offering, around August 2, 201, at the above F station around 06:29, the Defendants: (a) as if the oil price of G, the shipper of the freight truck, via the freight truck, 194.19 liter via the freight vehicle (H) was the same as G, the Defendants collected a subsidy welfare card from G; (b) paid 351,500 won, and (c) claimed a subsidy to the Gu office of Incheon among the victims.
However, in fact, since the Defendants were mainly 172.1liter in transit from G’s cargo vehicle, the Defendants were 22.09liter in 22.09liter. At that time, G received gasoline equivalent to the difference (22.09liter x 1,810 won/liter x 40,000 won) from G’s vehicle.
From June 17, 2011 to April 8, 2015, the Defendants: (a) caused only the transaction details of a subsidy welfare card without actual oil transaction, and (b) refund the amount of paid subsidies in cash; (c) as if they traded gasoline not subject to subsidies, the method of manipulating the transaction details as if they traded diesel, not subject to subsidies; (d) provided oil to the general vehicle that is not subject to subsidies, not subject to subsidies, and (e) provided the truck.
