1. On December 23, 2018, the Defendant committed the crime against the victim D, in the Ganyang-si’s residence, and the fact was written out that the Defendant sold H account to “I”, an Internet game, without any intent or capacity to sell the “H(H fourth rank) account, and reported the fact to the victim who visited the Internet site, “I will transfer KRW 300,000 won to the State, H account.” On December 25, 2018, the Defendant received KRW 300,000 from the victim to the post office account (J) account in the name of the Defendant (J) and received the money from the victim.

2. On or around December 26, 2018, the Defendant against the victim K puts a letter on or around the same residence, stating that he/she had no intent or capacity to sell a studio game room, and that he/she sells a 275,000 won in a studio game room to the victim who contacted with the victim by stating that “275,00 won is remitted to the remittance of KRW 275,000,000,” and then, he/she received 300,000 won from N bank account (P) on the same day.

In this respect, the defendant deceivings the victim and acquired the pecuniary profits equivalent to 275,000 won.

3. 피해자 Q에 대한 범행 피고인은 2018. 12. 26. 09:30경 위 주거지에서, 사실은 ‘꼬꼬마 과학책’을 판매할 의사나 능력이 없음에도 인터넷 사이트인 ‘L M 카페’에 꼬꼬마 과학책을 판매한다는 글을 올리고 이를 보고 연락한 피해자에게 “15만 원을 송금해 주면 꼬꼬마 과학책을 판매하겠다.”고 거짓말하여 이에 속은 피해자로부터 같은 날 R 명의의 S은행 계좌(T)로 15만 원을 송금하게 한 후 R로부터 16만 3,000원 상당의 컬쳐랜드 상품권에 대한 핀 번호를 전달받았다.
