1. Basic facts

A. The parties concerned are licensed real estate agents operating the Jongno-gu Seoul Metropolitan Government Office of Licensed Real Estate Agents (hereinafter “instant brokerage office”)

The Plaintiff served as a brokerage assistant of the instant brokerage office from March 10, 2017 to May 3, 2017.

B. The Plaintiff agreed to receive 25% of the remainder after deducting the operating expenses of the office from the actual income of the instant brokerage office with respect to the Plaintiff’s remuneration between the Defendant and the Defendant.

C. The revenue and expenditure of the instant brokerage office is the sum of 30,856,640 won received by the Defendant while operating the instant brokerage office during the Plaintiff’s said period of service as follows: (a) the sum of the revenue and expenditure incurred during the said period of service is KRW 10,073,129 won (i.e., KRW 5,626,229, the office rent of KRW 306,740, the advertising expenses of KRW 306,740, the office rent of KRW 344,90, the communication expenses of KRW 824,620, the office rent of KRW 820,620 and KRW 105,640, the office rent of KRW 105,640).

The aggregate amount of brokerage commission (excluding value-added tax following the issuance of cash receipts) of the same type on the lease date (excluding value-added tax) 1. D. The Defendant’s payment of remuneration to the Plaintiff is the sum of KRW 2,512,052 on April 29, 2017, and KRW 2,849,151 on August 1, 2017.
