Defendants shall be punished by imprisonment for six months.
However, the execution of each of the above penalties for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
A person who intends to operate a brokerage business shall register the establishment of a brokerage office with the head of a Si/Gun/Gu (hereinafter referred to as "registration authority") having jurisdiction over an area which intends to establish a brokerage office as prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport, notwithstanding the fact that the defendants are required to register the establishment of the brokerage office, they are to arrange the sale or lease of land or buildings
1. The Defendants’ co-principal
A. On April 10, 2017, Defendants in violation of the Licensed Real Estate Agents Act (hereinafter “Licensed Real Estate Agents Act”), around April 10, 2017, committed a brokerage business under the pretext of a seller’s commission, on the following grounds: (a) Defendant A: (b) the seller of the said land; (c) the seller of the said land; (d) the seller of the said land; and (e) the seller of the said land; (e) delegated the sale of the said land from E; (e) the seller of the said land; (e) the seller of the said land; and (e) the sales price at the time of the sales price; and (e) the place of conclusion of the
B. On October 12, 2017, Defendants in violation of the Licensed Real Estate Agents Act (hereinafter “Licensed Real Estate Agents Act”) committed a brokerage business with a total of KRW 17 million from a seller under the pretext of a brokerage commission and KRW 20 million from a buyer, on October 2, 2017, after being delegated the sale and purchase of land by the seller of the said land to I, the buyer company, and J, respectively, and after being delegated the sale and purchase of the said land to the buyer company, the seller of the said land and the buyer company for the purchase and sale of the said land. The Defendants, in violation of the Licensed Real Estate Agents Act, committed a brokerage business with a total of KRW 17 million from the buyer, and KRW 3 million from the buyer.
C. On December 19, 2017, the Defendants in violation of the Licensed Real Estate Agents Act, around December 19, 2017, entrusted the sale of land to K in the Jeju-si L office located in K on December 19, 2017, with the sale of land from the seller N, and provided good offices for sale of land in the Jeju-si M forest (612 square meters), including the sale price of the said land, the sale price at the present time, the settlement rate at the sale price, and the preparation of a place for concluding the sale contract, and received KRW 70 million from the seller as brokerage commission.
