A defendant shall be punished by imprisonment for a term of one year and two months.

Punishment of the crime

On February 16, 2012, the Defendant was sentenced to two years of imprisonment with prison labor for a violation of the Road Traffic Act (driving) and two years of grace period, and was sentenced to ten months of imprisonment with prison labor at the Suwon District Court on April 25, 2013 during the said grace period, and the judgment became final and conclusive on July 12, 2013, and the said suspended sentence becomes void and the execution of each of the said suspended sentence was terminated on July 17, 2014.

1. On August 22, 2016, the Defendant: (a) around 22:53 on August 22, 2016, 2016, while boarding a taxi driven by the victim C (the age of 43) on the front of the "Sari-gu Sari-si Saemaul Treasury" located in Suwon-gu, Suwon-si; (b) was fringing the time for the victim to return to the road; and (c) the victim was driving the said taxi to the police box of the Suwon-gu, Suwon-si, Suwon-si, Police Station E

At around 23:06 on the same day, the Defendant, while disputing the victim at the above police box, was assaulted against the victim on one occasion by taking the floor of the victim's right boom.

2. 공무집행방해 피고인은 2016. 8. 22. 23:20경 위 파출소에서, 위와 같이 C을 폭행하여 현행범인으로 체포되어 인치되어 있던 중, 경찰관들이 자신에게 수갑을 채웠다는 이유로 화가 나, 경찰관들에게 “야, 씹새끼야, 내가 높은 사람한테 전화 한 통화 하면 너 죽는다.”라고 욕설을 하다가, 위 파출소 소속 경위 F을 향하여 침을 뱉고, 이어 피고인의 수갑을 풀어주려고 하는 위 파출소 소속 순경 G에게 “내 아들보다도 어린 놈의 새끼가 어디서 건방지게.”라고 욕설을 하면서 발로 G의 낭심 부위를 1회 걷어찼다.

Accordingly, the defendant interfered with legitimate execution of duties concerning F and G crimes prevention, suppression, investigation, etc., which are police officers.
