Defendants shall be jointly and severally liable for KRW 21,467,521 and KRW 20,747,464, respectively, from June 19, 2019.

1. Basic facts

A. The Plaintiff entered into each of the instant lease contracts and joint and several sureties entered into a lease agreement with the Defendant Company on two occasions, and the Defendant C as the representative of the Defendant Company at the time, and jointly and severally guaranteed the Defendant Company’s obligations under each of the respective lease agreements.

On May 31, 2016, the first lease contract 201, which was concluded on May 31, 2016, the acquisition cost of the D lease object E is KRW 105,00,000,000 for 36 months of the lease period of KRW 3,073,286 (1) per annum 25% per annum). On the other hand, on May 31, 2015, the Plaintiff entered into a transfer contract with the Defendant Company to secure the obligation of the Defendant Company arising from the first lease contract between the Defendant Company and the Defendant Company with the amount of KRW 29,00,000,00 as the secured obligation to the Plaintiff. However, on the other hand, the Defendant Company entered into a transfer security agreement with the Defendant Company to use for the Defendant Company by means of an alteration of possession.

B. From March 18, 2019, Defendant Company failed to pay the principal and interest of the lease fees under each of the instant lease agreements from March 1, 2019. The obligation to pay the unpaid principal and interest of the lease as of June 18, 2019 is as follows: (a) KRW 11,768,589 interest 513,444 delay damages 206,613,613,612,48,648,646,210 (13,46,346,3210) interest losses amounting to 14,385 interest rate, 74,50 interest rate, 322,506, 1530, 1206 deposit, 120,000, 816, 257, 2758, 2167, 267, 257, 2757, etc. of the Plaintiff’s each of the instant lease agreements.
