Reasons
Punishment of the crime
1. Defendant A
A. At around 22:00 on January 28, 2019, the Defendant prepared 52 drum cards to allow 5 persons, such as E, who were aware of the office located in YD from C to engage in gambling.
The Defendant, from 22:00 to 01:05 on the same day, received fees of KRW 10,000 to KRW 30,00 each time from those who provided a place and card to those who participated in gambling and received 50,000 won per hour from those who participated in gambling on the pretext of providing gambling places.
Accordingly, the defendant set up a place for gambling for profit-making purposes.
B. On January 28, 2019, from around 22:00 on September 28, 2019 to around 01:05, the Defendant ambling with F, G, H, E, and I (each of the following days), followed the first four card using 52 card at the said port office from around 22:00 to around 01:05, and carried out hosting three times by exchanging the card in the order of priority, and ultimately, after the final distribution of the card, the Defendant ambling the card by bringing money received by a person with a different pattern or a low number of card, among the remaining cards, from each other.
2. On January 28, 2019, the Defendant, despite being aware of the fact that the above paragraph 1’s place of home is used as a gambling place, aided and abetting the establishment of a gambling place for A by lending an office after receiving KRW 200,000 per time from A.
3. Defendant B, at the time and place of the above-mentioned 1’s paragraph (a) as the wife of the Republic of Korea, confirmed stuffs who found stuffs through CCTV, and provided guidance to those who found gamblings to the office, or assisted the opening of gambling places by providing guidance to those who gamblings to the office, or by taking the heart of gamblings.
