A defendant shall be punished by imprisonment for a term of one year and four months.
An application for compensation by an applicant for compensation shall be dismissed.
Reasons
Punishment of the crime
1. On June 29, 2012, the Defendant forged private documents and utteringed the perjury document: (a) although the name of the Defendant’s E’s workplace located in Daejeon-gu, Daejeon-gu, could not be known; (b) the Defendant, without authority, intended to obtain a credit card using the personal information of the Defendant, which was known to the applicant for the issuance of the credit card; (c) however, in the form of the application form for the exclusive use of the credit card holders of the SK, the Defendant entered the name of the customer in the “C” and the “C” in the name column of the customer information column using the verification pen, and signed the name of the applicant customer column in the “F” and the “D E” column of the resident registration number column.
Accordingly, the Defendant, for the purpose of uttering, forged a letter of application for the exclusive use of an individual member in C’s name, which is a private document on rights and obligations, and delivered a forged application for the exclusive use of an individual member with no knowledge of the fact to a credit card solicitor who is not aware of the fact as above, as if it were a genuine document, and forged and used the private document in C’s name in the above manner two times from that time to December 12, 2012, as shown in the attached list 1.
2. On August 7, 2012, the Defendant entered C’s name and resident registration number in the customer information column of the online new card subscription form using a computer without authority for the purpose of exercising the Defendant’s business establishment via E in Daejeon-gu, Daejeon-gu, Daejeon-gu, and entered C’s name and resident registration number in the customer information column of the online new card subscription form, and then applied for issuance of C’s credit card by online transmission of file of the above subscription form via a certified electronic certificate.
Accordingly, the defendant has forged a file of a new card member application in C's name, which is a prior recording of rights and obligations, and the above new card company's employee who is not aware of such fact is the file of the above member registration application.
