1. The plaintiff's claim is dismissed.

2. The costs of the lawsuit shall include all the parts arising from the participation of the defendant intervenor.

1. Details of the petition review and decision;

A. The Plaintiff is an incorporated educational foundation that establishes and operates the C University, and the Intervenor (hereinafter “ Intervenor”) is an associate professor who takes charge of the field major in the D major of C University (hereinafter “caton major”).

B. On December 12, 2016, the Plaintiff was informed by the Intervenor that he/she omitted part of his/her lectures from the graduates and students enrolled in the stable-gu major, and that he/she provided education guidance poorly, and conducted an investigation into the said information from January 12, 2017 to February 24, 2017 through the C University Teachers’ Investigation Committee.

C. Based on the results of the foregoing investigation, the Cuniversity Teachers’ Personnel Committee decided on April 18, 2017 to request disciplinary action against the Intervenor, and the president of Cuniversity requested disciplinary action against the Intervenor on May 2, 2017. Based on the above proposal, the Plaintiff’s Disciplinary Committee opened on June 5, 2017 decided to request disciplinary action against the Intervenor on the ground that the following disciplinary action constitutes a violation of good faith and a violation of good faith.

1. Unauthorized demotion and non-performance of teaching hours;

(a) Unauthorizedly decided lecture: The current status of the unauthorized decided lecture (total number of 196 instances, 245 hours) that a person fails to implement one of the classes twice a week during the previous semester between 2014 and 2016;

(b) Non-performance of class hours: The current status of non-performance of class hours during the previous semester between 2014 and 2016, while the prescribed hours during the class are not fulfilled for at least 30 minutes each (total 150 times, 75 hours);

2. Handling of false withdrawals;

(a) False entry and resolution: The current status of false entry and resolution processing for the relevant subjects even though some classes have been failed to perform such lectures or part of such lectures;

3. Submission of false achievements and preparation of false documents of financial subsidies;

(a) Submission of false achievements: The current status of the submission of false achievements by submitting the false performance record of non-credit education programs for one semester of 2016;

(b) False Preparation (Direction) of Documents: Majors in the department of D previously D and E on January 19, 2017;
