The Daejeon District Court Decision 2019Kao 20269 against the plaintiff of the non-party C corporation shall make a decision on the amount of litigation costs.
Reasons
1. Facts of recognition;
A. The amount of litigation cost No. 2019k. 27) Decision 1) Limited Company D (hereinafter “D”) was awarded a favorable judgment by the Daejeon District Court against C Co., Ltd. (former trade name: E Co., Ltd.; hereinafter “C”) by filing a lawsuit against the third party as 317.
Accordingly, C filed an appeal, and the appeal was accepted, and the judgment dismissing D’s claim was pronounced (Seoul High Court Decision 2014Na13777), but D re-appealed and remanded the conjunctive claim (Supreme Court Decision 2015Da28548). (2) In the case of the reversed judgment, the Plaintiff participated in the lawsuit on the ground that the Plaintiff acquired the subject matter of the lawsuit from D and subsequently partly accepted the Plaintiff’s claim (Seoul High Court Decision 2017Na221), and on October 25, 2018, the Plaintiff’s appeal on the part against the Plaintiff among the above judgment became final and conclusive (Supreme Court Decision 2018Da37655, Supreme Court Decision 2018Da37675, Oct. 27, 201) and the judgment of the appellate court became final and conclusive that the Plaintiff was paid to the Plaintiff on the ground that the amount of the lawsuit was determined to be KRW 209Da201927, Mar. 26, 2019.
B. The Plaintiff filed a third-party lawsuit against Daejeon District Court 2017, 105566, the Daejeon District Court rendered a dismissal judgment on September 13, 2018, and the said judgment became final and conclusive around that time.
2) On May 29, 2019, the Daejeon District Court Decision 2019Kao-20269 (hereinafter referred to as "the each of the instant orders," which became final and conclusive around June 2019 (hereinafter referred to as the "the foregoing Order and the Daejeon District Court 2019Ka-27). C, upon receipt of the above ruling, determined that "the amount of litigation costs to be paid to the respondent (Plaintiff) is KRW 6,010,303," which became final and conclusive around May 29, 2019.
