1. The defendant shall take precedence over each point of 16, 17, 18, 19, and 16 of the attached Form No. 16, 17, 18, 19, and 16 to the plaintiffs of Ansan-si.
Reasons
1. The following facts can be acknowledged in full view of the following facts: there is no dispute between the parties; Gap evidence 1-1; and the purport of the entire pleadings as a result of the commission of appraisal to the Korea Land Information Corporation by this Court.
The Plaintiffs completed the registration of ownership transfer on April 29, 2015 with respect to D large 73 square meters (hereinafter “instant land”) in Ansan-si, Dong-si on April 29, 2015, each of 1/2 shares transfer on March 26, 2015.
나. 피고는 이 사건 토지 중 별지 도면 표시 1, 2, 3, 4, 5, 6, 7, 8, 14, 13, 12, 11, 1의 각 점을 차례로 연결한 선내 ㈁ 부분 대지 19㎡(이하 ‘이 사건 대지’라 한다)를 점유하고 있는데, 이 사건 대지 안에는 피고 소유의 처마(별지 도면 표시 16, 17, 18, 19, 16의 각 점을 차례로 연결한 선내 ㈂ 부분 2㎡이다), 본건물(별지 도면 표시 3, 4, 15, 16, 17, 18, 3의 각 점을 차례로 연결한 선내 ㈃ 부분 4㎡이다)과 가설건축물(창고, 별지 도면 표시 4, 5, 7, 8, 14, 15, 4의 각 점을 차례로 연결한 선내 ㈄ 부분 1㎡이다, 이하 통틀어 ‘이 사건 처마, 본건물 및 가설건축물’이라 한다)이 있다.
2. Determination
A. According to the above facts of recognition as to the cause of the claim, the defendant is obligated to deliver the instant land to the plaintiffs, who are the owners of the instant land, and remove the instant eaves, main building, and temporary building, unless there are other special circumstances.
B. The defendant's assertion 1) The defendant's assertion that he had infringed part of the land of this case, even if the defendant had already occupied the land of this case with the intention of 20 years or more since January 7, 1995, and thus, he has a legitimate right to possess it after the completion of the prescription period.
B. The registration of ownership transfer is made to a third party with respect to the real estate, even if the acquisition by prescription for the possession of the real estate has been completed.
