A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who works for the 3th Armed Forces of the Army of the Republic of Korea for the Army of the Republic of Korea and has been in charge of administrative affairs in the military unit as a personnel administrative soldier.

1. Preparation of a false official document;

A. On May 23, 2016, the Defendant prepared a false administrative document by taking advantage of the status of a personnel administrative soldier at the 3 large C Office at the Army Group 31 joint and several 3 large C Offices at the Army, and raised a false commander’s confirmation to make leave.

In fact, the Defendant: (a) on February 9, 2016 to February 11, 2016, using D’s certificate of leave for three (3) months during D boundary support service; (b) on the basis of D’s certificate of leave for three (3) days; (c) on the column to which the commander belongs, the Defendant, using a computer, submitted it to G by entering the “C Headquarters,” “F,” “F,” and “F,” and “F,” in the name column, “A,” and “F,” and “F,” and submitted D dispatch to D in the content column; and (d) “A” 2016-06-03” in the column of the departure date, “3, “the number of days of leave arrival”, “the date of leave arrival”, and 2016-6-6-5, respectively, and submitted it to G to G by signing it.

Accordingly, for the purpose of uttering, the Defendant drafted a false copy of the certificate of commander, which has been signed in the name of the 3 large C of the 3th National Army of the Republic of Korea, the 2nd Military Association of the Republic of Korea.

B. On July 22, 2016, the Defendant prepared a false administrative document using the status of an administrative soldier at the 3 large C Office of the 3rd Armed Forces of the Army at the Army (hereinafter referred to as the “The 2nd Army”) office, and raised a false commander’s confirmation in order to grant leave.

On July 22, 2016, the Defendant: (a) even though he did not have received a leave of leave from a commander on a large-scale basis, the Defendant used the computer to “C Headquarters”, “F” in the rank column, “F” in the name column, and “A and the parallel column” in the name column; and (b) the Defendant’s event of the Gyeonggi-do Kimpo-si, “A and the group of leave” in the name column.
