F이 침을 맞고 나서 누군가가 F에게 닦으라며 휴지를 주었고, 계속 말을 하다가 두 사람이 세수를 하러 갔습니다”는 취지로 다소 모호한 진술을 하였으며, 증인 H은 이 법정에서 “화장실에 가 있어서 피고인이 F에게 침을 뱉는 것을 보지 못했다. 제가 화장실에 다녀오니까 사건이 거의 종료되어서 피고인은 베란다에 있고, F은 얼굴에 침을 뱉었다는 이야기를 하면서 샤워장에 가서 얼굴 씻고 온 것을 봤습니다”라고 진술하고 있고, 증인 I은 이 법정에서 “피고인이 F과 가까운 거리에서 언쟁을 하였는데 F으로부터 침을 맞고 약 1~2초 내지 2~3초 후에 바로 F에게 침을 뱉는 것을 보았다고 진술하면서도 구체적으로 어떤 상황을 보았는지에 대하여 답변을 못하다가 F이 침을 닦는 것을 본 것 같다”는 취지로 진술하고 있다.
