A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

The Defendant, around September 24, 2019, connected “D”, which is an Internet game site in Suwon-si B, Suwon-si around September 24, 2019. On the ground that, even if having received money from other game participants, the Defendant made a false statement to the effect that “F (F) would sell money if money is remitted to 30,000 won” through hosting functions despite having no intent or ability to sell game money from other game participants, the Defendant received 30,000 won from the victim to the G bank account (H) account in the name of the Defendant on the same day.

In addition, the Defendant received a total of KRW 983,500,00 from 17 victims in total, from December 24, 2019, by the same method as indicated in the list of crimes in attached Table 1, from the victim to December 24, 2019.

Accordingly, the defendant was informed of the victims and received property from each victim.

Around 21:30 on October 11, 2019, the Defendant visited “D”, which is an online game site, at C in Suwon-si, Suwon-si around 21:30 on October 21, 2019. The Defendant stated to the effect that, even if he/she received money from another game participant, he/she would sell the game items if he/she remitted 63,000 won to the victim I through the hosting function, regardless of the absence of intention or ability to sell the game items.

As above, the Defendant, by deceiving the victim as above, received 63,000 won from the victim as the sales price of game items on the same day from the victim, and acquired them through a G bank account (H) in the name of the Defendant.

On November 29, 2019, the Defendant sent 3,000 billion won to the Victim K by accessing the “D”, an Internet game site, at the PC located in Suwon-do, Suwon-do on November 29, 2019, and selling 3,000 won (game money) to the victim K.

‘False speech' was made.

However, in fact, the defendant thought that he received money first from the victim and used it for the cost of living, and he did not have the intention or ability to sell the game money.
