피고인은 2014. 11. 4. 11:00경, 자신의 부동산사무실과 연접해 있는 양산시 B에 있는 C 앞 노상에서 경계 측량 없이 펜스를 설치한 일로 격분하여 피해자 D에게 “야이 뚱댕이 같은 년아, 나이 40에 애도 못 낳는 년아” 라고 큰소리로 말하여 공연히 피해자를 모욕하였고, 같은 시간 같은 장소에서 C으로 출근하는 피해자 E에게 “저 년도 저거 애비를 닮아서, 저 년도 못됐네, 얼굴이 못생겨서 시집을 못 가네” 라고 큰소리로 말하여 공연히 피해자를 모욕하였다.
