A defendant shall be punished by imprisonment for not less than one year and six months.
4,200,000 won shall be additionally collected from the defendant.
Reasons
Punishment of the crime
The defendant is not a person handling narcotics.
1. On June 13, 2013, at around 19:40 on June 13, 2013, the Defendant received 600,000 won from C with the request to rescue psychotropic drugs (one philopon; hereinafter “philopon”). At around that time, the Defendant issued 0,000 won to F on the road near the E Hospital located in Seongbuk-gu Seoul, Seongbuk-gu, Seoul, and then delivered 0.8 g of the philopon to C at the front of the implied Dong-dong point of the Seoul Jungdong-gu, Seoul.
Accordingly, the defendant assisted the trade of philophones between C and F.
2. On July 18, 2013, at around 21:00 on July 18, 2013, the Defendant: (a) received 1.1 million won in the name of the purchase price from C at the H restaurant run by the Defendant in Dobong-gu Seoul Metropolitan Government upon the Defendant’s request to rescue the phiphone from C; (b) at around 2:00 on the same day, at the above restaurant toilet, the Defendant 1.1 billion won in the above cafeteria and 1.6g of phiphone to F; and (c) delivered C around the above restaurant, approximately 1.6g of phiphonephone to C.
Accordingly, the defendant assisted the trade of philophones between C and F.
3. On July 21, 2013, the Defendant: around 18:00 on July 21, 2013, received KRW 300,000,000 in total, including KRW 300,000 and KRW 200,000,00,000 from the E Hospital near Seongbuk-gu, Seoul, for the purchase price upon C’s request to rescue phiphones; and then, the Defendant issued approximately 0.8 g of the said phiphones to F in the back frame of the above E Hospital, after receiving approximately KRW 300,00,00 in total, including KRW 300 and KRW 200,00 of the Defendant’s money.
Accordingly, the defendant assisted the trade of philophones between C and F.
4. On July 31, 2013, the Defendant, around 15:00 on July 31, 2013, received 200,000 won for the purchase price upon C’s request to rescue phiphones from E Hospital Construction on the roads of E Hospital in Seongbuk-gu Seoul, Seongbuk-gu, Seoul, along with C’s request to rescue phiphones, and then to F in the back part of E Hospital.
