A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Criminal facts
1. On October 5, 2015, the Defendant, on September 30, 2015, remitted 1.3821575 bitcos (400,000 won) to the bitco-owner’s address known to the Defendant to purchase marijuana from around 13:05 around 13:05 on the sales of non-registered narcotics (one name C; hereinafter “C”).
On October 5, 2015, at around 19:09, the Defendant received approximately 10 grams of hemp, delivered in the way of express bus freight, using Kwikset service, at F express bus terminal at an insular location in Seoul E-building 301.
Accordingly, the defendant purchased marijuana.
2. On October 14, 2015, the Defendant: (a) transferred 1.34780889 bitcoin (an amount equivalent to KRW 400,00) to purchase marijuana from C around October 14, 2015, in the same manner as that described in paragraph 1, to purchase it.
After that, around October 2015, the Defendant received approximately 10 grams of marijuana delivered to the I terminal at H’s location located in Yongsan-gu Seoul Metropolitan Government G around 18:0, using Kwikset service.
Accordingly, the defendant purchased marijuana.
3. On November 2015, the Defendant: (a) transferred 0.704325 bitcos (on November 4, 2015, equivalent to KRW 400,00) using the same method as described in paragraph 1, to purchase marijuana from around 20:46 around November 4, 2015.
After that, on November 2015, the Defendant received 10 grams of the hemp 10g, delivered as the express bus freight, using Kwikset service, at a place in the vicinity of H located in Yongsan-gu Seoul Metropolitan Government, G, for the F high-speed bus terminal, around 18:00.
Accordingly, the defendant purchased marijuana.
