Reasons
Punishment of the crime
In order for a person who has obtained permission for trucking transport business to receive a fuel subsidy, he/she shall receive the fuel directly from the station or the person who is fixed facility of the oil station in order to receive the fuel subsidy.
1. Defendant A is a person who has obtained permission for the transportation business of C and D freight vehicles and has employed B to drive D freight vehicles.
On February 3, 2014, around 15:44, the Defendant: (a) contacted non-registered petroleum sellers E and F through B at the street located in Yangyang-si, Yangyang-si; (b) received fuel purchase cards in the name of the Defendant to pretend that the Defendant purchased a normal transit equivalent to KRW 484,00 from the H oil station located in Ulsan-gun, Ulsan-gun; and (c) obtained pecuniary benefits equivalent to that amount by having a public official belonging to the office of the office of Ulsan-gu, Ulsan-gu, U.S., by settling the payment with the credit card terminal of the said gas station in order to pretend that the Defendant purchased a normal transit equivalent to KRW 484,00 from the oil station located in Ulsan-si, Ulsan-si.
Ultimately, as above, the Defendant deceiving a public official in charge of the victim U.S. office, and let the public official in charge pay 9,844 won of the paid-in subsidy to the credit card company, thereby acquiring pecuniary profits by releasing his liability to the credit card company equivalent to the same amount, and, as shown in attached Table 1, as shown in attached Table 1, from February 3, 2014 to December 25, 2014, the Defendant was supplied to C, D from February 3, 2014 to December 25, 2014 with light oil identifying the source of the freight, and was supplied through normal transit at HH oil station, I oil station, etc., and deceiving the public official in charge of the victim’s U.S. office, Yangsan-do office, and Yangsan-si, and it is owned by the victim’s public official in charge of this.
