Reasons
Punishment of the crime
The Defendant is a person who has been employed as a sales employee at a mobile phone agency in the name of “C” on the 1st floor of Seocho-gu, Seocho-gu.
around 12:00 on April 2, 2019, the Defendant visited the above sales store and purchased LG electronic G7 (LM-G710N) short term 898,700 won, and subscribed to E, and drafted the above documents on the condition that the Defendant would pay KRW 86,930 on a monthly basis with the subsidy of KRW 678,000 as “F” in the “application for the change of short term / USIM”.
However, in order to collect more sales fees from the above E, the Defendant had expressed the intent to modify the content of the contract at will by preparing and submitting the “application for change of / USIM” without the consent of the victim.
1. On April 2, 2019, the Defendant: (a) around 12:30, at the above sales store, selected “a discount equivalent to a subsidy” at a discount of KRW 475,200,00 at a premium rate of KRW 79,00; (b) revised important matters concerning the method of receiving benefit when changing the terminal device of the above documents for 24 months on the condition that he/she paid KRW 91,490 per month, and entered “D” and signature in the victim’s name “D”, “G” on the day of the statutory life of the year and the customer column.
Accordingly, for the purpose of uttering, the Defendant forged a “written application for change of short term/USIM” in the victim D, a private document related to rights and obligations.
2. On April 2, 2019, the Defendant, at the place indicated in Paragraph 1, around April 12, 2019, displayed a forged private document by sending it to a person in charge of E Co., Ltd., who is aware of the forgery at the place indicated in Paragraph 1, as stated in Paragraph 1, as if the “application for the change of short-term / USIM” was a document duly formed.
