나. 이 사건 공사계약 체결 당시 공사대금은 설계, 인허가 시에 계약금 1,100만 원, 착공 시에 1차 기성금 2,255만 원, 모듈, 인버터, 구조물 출하 전에 2차 기성금 1억 6,940만 원, 준공(발전소 사용전검사 완료 시점) 후 7일 이내에 잔금 2,255만 원을 각 지급하는 것으로 정하고, 공사기간은 공사착공 협의일로부터 6개월로 정하였으며, 총 5개의 발전소 부지 중 피고의 발전소 부지는 이 사건 임야 중 별지 도면 표시 14 내지 19, 21, 20, 14의 각 점을 차례로 연결한 선내 ㈃ 부분 1,622㎡로 예정되어 있었다.
