A defendant shall be punished by imprisonment for not less than two years and six months.
Reasons
Punishment of the crime
1. Around June 5, 2016, the Defendant: (a) performed drinking in front of the second floor D (E, 51 years old), the second floor of the Ma-si Building C, the Defendant: (b) carried the alcohol before and found the victim “E” in order to shut down the door of the victim; (c) however, the Defendant forced the victim to fish the Defendant’s right shoulder on two occasions with the hand hand that the victim refused it and reported to the police; and (d) forced the victim to fish the hand-on hand, which was carried by the victim’s hand, with the left hand.
As a result, after suppressing the victim's resistance, the Defendant took a gallon juthm of the victim's market value of KRW 800,000,000.
2. On June 5, 2016, the Defendant violated the Act on Financial Business Specializing in Fraud and Credit Business: (a) ordered the victim G management “H” of the victim G, which is located in the Gu Government-si F, to make a sales slips by presenting the credit card of the said national bank, as if the credit card was a lawful holder, as described in paragraph (1), as if the credit card was a legitimate holder, and used the signature on the said slips.
However, the defendant did not have the intention or ability to settle the price even if he used the credit card, not the legitimate right to use the credit card.
The Defendant had been provided from the injured party with alcohol and alcohol equivalent to the market price of KRW 650,00,000 at the same place. From around that time to around 18:37 of the same day, the Defendant acquired the economic benefits equivalent to the total market price of KRW 1,495,00 through three times, such as the list of crimes in attached Form 1, and used the strong credit card.
