A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. A theft: (a) around 02:00 on March 16, 2013, the Defendant: (b) opened the victim’s clothes; and (c) stolen the Samsung Card owned by the victim, holding one copy of the victim’s Samsung Card in the victim’s clothes room in Ulsan-gu B, Ulsan-do.
2. Fraud or violation of the Specialized Credit Finance Business Act;
A. On March 19, 2013, around 03:23, 2013, the Defendant ordered the victim F’s G main points located in Ulsan-gu, Ulsan-gu E to pay the price, and the Defendant was provided with alcohol, alju, etc. equivalent to the total market value of KRW 480,00,000 from the victim, and acquired the stolen Samsung Card as if it were a legitimate licensee, and then used the stolen credit card by issuing it.
B. On March 23, 2013, at around 18:22, the Defendant received 110,000 won or less from the J-U.Y of the victim I located in Ulsan-gu, Ulsan-gu in the same manner as the preceding paragraph, and acquired pecuniary benefits, and used stolen credit cards.
C. On March 23, 2013, around 19:25, the Defendant received clothes equivalent to KRW 89,000 from the victim's lot shopping store located in Ulsan-dong 1480-1, Ulsan-gu, Ulsan-dong, in the same manner as the preceding paragraph, and acquired them by deception and used stolen credit cards.
On March 23, 2013, at around 20:26, the Defendant obtained economic benefits by being provided with marina services equivalent to KRW 165,00 in the same way as the preceding paragraph at the victim L's massage treatment facility located in Ulsan-gu K, Ulsan-gu, and used stolen credit cards.
