1. The defendant A shall be punished by imprisonment for six months and by imprisonment for four months; and

2. However, for two years from the date this judgment has become final and conclusive.

Punishment of the crime

Defendant A was sentenced to a suspended sentence of one year in Seoul Western District Court on April 18, 2013 for a violation of the Act on the Control of Narcotics, etc., and Defendant B was sentenced to a suspended sentence of three years for a violation of the Act on the Control of Narcotics, etc., and Defendant B was sentenced to a fine of three million won in Seoul Eastern District Court on January 18, 2013 for a violation of the Act on the Control of Narcotics, etc.

Criminal facts

Even if the Defendants were not narcotics handlers, they dealt with JWH-018 (one-day “B” or “Sph”; hereinafter referred to as “B”) psychotropic drugs as follows:

1. Defendant A

A. On March 23, 2012, the Defendant sent 90,000 won from the Defendant’s corporate bank account (E) to the Defendant’s bank account in the name of D (F) from March 23, 2012. On the same day, around 24:00, the Defendant purchased hub 4 (16g) from B, which came to know through D within the BM passenger car located in Yongsan-gu Seoul, Yongsan-gu, Seoul.

B. At around 23:00 on October 2012, the Defendant diversed the pipe created from J’s house located in Yongsan-gu Seoul, Yongsan-gu, Seoul, with a fire attached, and smoked with K, J, etc.

2. After receiving KRW 900,000 from D upon request from A on March 23, 2012 to the Agricultural Cooperative (L) account under the name of the Defendant, the Defendant purchased from P in front of the “Nju store” located in Yongsan-gu Seoul Metropolitan Government, “Nju store” from P around 21:0 on the same day, and sold KRW 90,000,000 from P in front of the “Nju store” located in Yongsan-gu, Yongsan-gu, Seoul, and around 24:00 on the same day, 4 BM car stopped on A’s BM car parked on the roads of the H university’s Y.
