1. 성폭력범죄의처벌등에관한특례법위반(13세미만미성년자강제추행), 아동복지법위반 피고인은 2014. 8. 29. 16:00경부터 18:00경까지 사이에 서울에 있는 E아파트 피해자의 집에서 피고인이 과외교사로서 가르치는 피해자 F(8세)의 성기를 손으로 움켜 잡고, 피해자의 다리 사이에 피고인의 발을 집어넣어 피해자의 성기에 닿게 하고 떨면서 움직이고, 피해자의 젖꼭지 부위를 손으로 잡아당기고 비트는 등 13세 미만의 미성년자인 피해자를 강제로 추행함과 동시에 아동에게 성적수치심을 주는 성희롱ㆍ성폭력 등의 학대행위를 하였다.
