A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant had a mind to open a mobile phone in B’s name using his personal information known to him.

1. On June 1, 2013, the Defendant forged official document: (a) notified, without authority, of B’s resident registration numbers to the name influories who forged B’s resident registration certificates through the Internet carpet bulletin board; (b) made a request for the creation of B’s resident registration certificates; and (c) remitted KRW 20,000 in return.

The name-free person was made and sent to the defendant by making a file of resident registration certificate B's name and resident registration number.

On June 3, 2013, the Defendant sent the file to C, a mobile phone sales agent, using the Internet facsimile around June 3, 2013.

They were printed out in writing.

Accordingly, the Defendant, in collusion with the above-mentioned person, forged the resident registration certificate of B in the name of the head of the Daegu-gu Office which is an official document.

2. On June 3, 2013, the Defendant exercised the forged official document in the above C, located in Jin-gu Busan, Jin-gu, Busan, by allowing the above C to deliver a copy of the falsified resident registration certificate to the said C employee who is aware of the circumstances.

3. On June 3, 2013, the Defendant: (a) entered “B” in the customer name column, “E” in the resident registration number column, “E” in the State column, and “B” in the applicant customer column without authority for the purpose of exercising the trade name in the form of a new contract, which is a mobile phone opening document; (b) written on the customer name column, “B” in the State column, “E” and “B” in the applicant customer column; and (c) signed the female next thereto.

Accordingly, the Defendant forged the above new service contract in the name of B, a private document on rights and obligations as above.

4. On the same day, the Defendant may be aware of the fact through Kwikset service of a new service contract, which is a forged mobile phone document, such as the above paragraph (3).
