1. The Defendant’s KRW 142,926,750 for the Plaintiff and KRW 5% per annum from September 13, 2016 to September 27, 2017.
Reasons
1. Facts of recognition;
A. On November 6, 2013, the Plaintiff and the Defendant concluded a comprehensive transfer and takeover contract on the store name “B store” (hereinafter “instant store”) with the following content.
(hereinafter “instant contract”). Article 1. Indication of the contract
1. Name of contract: Comprehensive transfer and takeover contract with the bank for bankruptcy; and
2. Place of contract occupation: D1st floor in a regular Eup/Myeon; and
3. Comprehensive transfer and takeover contract period: Payment of the contract amount under Article 2 (V.A.T separately) of the contract amount between November 1, 2013 and August 34, 2017: 170 million won (V.A.T separately);
1.The payment of 170,000,000 won of the contract price under this Agreement shall be as follows:

(입금일 : 2013. 10. 8.) ◎ 중도금 2차 : 상호 합의된 일자에 3,000만 원을 피고가 원고에게 현금으로 지불한다.
(입금일 : 2014. 1. 30.) ◎ 잔금 : 상호 합의된 일자에 1억 2,000만 원을 피고가 원고에게 현금으로 지불한다.
(입금일 : 2014. 10. 31.) ◎ 부가세지급은 사업자명의이전시를 원칙으로 하되, 실제 납부일 전으로 변경할 수 있다.
◎ 계약대금 완불시까지인 2013. 11. 1.부터 2014. 10. 31.까지(총 12개월) 피고는 원고에게 매월 1일자에 150만 원씩 지급한다.
Article 3 Comprehensive Transfer Transfer and Receipt Contract Goods
1. The right to operate a store and the interior of facilities shall be transferred or taken over at the present date of the commencement of the contract as well as all containers, interiors, office fixtures, all kinds of raw materials and supplementary materials;
Article 4 (B) Transfer of Title of Enterpriser
1. The transfer of the business name to the business owner due to the defendant shall be after the commencement date of the contract;
2. The defendant shall complete the transfer of the business name by the time of the second payment of intermediate payment.
3. The commencement date of the contract.
