A defendant shall be punished by imprisonment with prison labor for four months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant was selected as a recipient of basic livelihood security from around August 2011 and received support from the State for basic livelihood security benefits.
When the details of a residence area, household composition or lease contract are changed, or matters related to a person under duty to support, such as whether a person under duty to support exists or a person under duty to support is changed, or matters necessary for the formulation of a self-support assistance plan, such as the matters concerning income and property of a beneficiary and a person under duty to support, working ability of a beneficiary, employment status, etc.
The Defendant received income equivalent to KRW 48 million from April 2014 to July 2016, when operating “D” in the name of mother C in the name of his/her father-gu, Busan; from around 2017 to April 2019, the Defendant was paid KRW 24,046,260,00,000 for the said period, including where he/she received approximately KRW 70 million from “F restaurant” and “F restaurant” in the G from around 2017 to around 2019; and was paid basic livelihood security benefits of KRW 20,444,780 from around May 2014 to around 2019.
As a result, the Defendant received basic living cost by fraud or other improper means.
