Reasons
Punishment of the crime
I. Crimes on December 25, 2010
1. On December 25, 2010, the Defendant: (a) concluded a lease agreement with F on officetels 703 of the former E-building No. 703 owned by the Defendant’s wife at the C Licensed Real Estate Agent Office located in Ansan-si, Busan-si, B building 107; (b) concluded a lease agreement with G as to the instant E-building No. 703, which is owned by the Defendant’s wife; (c) made G, the broker of the broker’s office, prepare and output the “office charter lease contract, the portion to be leased: 703, the deposit:00 million won, and the lessor; and (d) forged one copy of the lease agreement in the name of D, a private document, without authority, for the purpose of exercising the seal affixed by the said D.
2. At the time and place specified in the foregoing paragraph (1), the Defendant: (a) presented the forged lease contract to F, who was aware of such fact; and (b) exercised the contract as if it were duly formed.
II. Crimes on November 28, 201
1. Proxy letter;
A. On November 28, 201, the Defendant forged private documents: (a) concluded a lease contract with J Licensed Real Estate Agent Office in Ansan-gu, Busan-si; (b) K and the office of the broker of the broker office; (c) made L, a broker of the office of the broker office, to use a computer, “a delegation letter, indication of the delegated real estate: 703 of the building E-gu in Ansan-si; (d) written and printed all the rights to lease on a monthly and monthly basis of the delegated real estate; and (e) forged a letter of delegation in the name of D, a private document on rights and obligations, without authority, for the purpose of exercising the said D’s seal affixed thereon; and (c) forged a letter of delegation in the name of D, a private document.
B. At the time and place specified in the above paragraph (a), the Defendant used the forged power of attorney to K as if it had been duly formed.
2. A lease contract;
A. The Defendant forged a private document on the date, time, and place described in the above 1’s A, and on the officetels described in the K and the above 1’s B.
