Punishment of the crime
[criminal history] On February 9, 2011, the Defendant was sentenced to 8 months of imprisonment with prison labor for larceny, etc. at the Incheon District Court’s Incheon District Court’s Incheon District Court’s Branch on November 17, 201, sentenced to 1 year and 6 months of imprisonment with prison labor for larceny, etc. on March 22, 2013, and completed the execution of the sentence in Gangnam Prison prison on January 17, 2015.
【Criminal Facts】
1. Habitual theft;
A. At around 18:40 on August 14, 2015, the Defendant: (a) cut off shopping bags located in Jung-gu Seoul, Jung-gu, Seoul; (b) the victim F’s access to a shopping camera where one eye was put in shopping bags and one eye was sold in shopping bags; and (c) then cut off the packaging containing one of the KRW 4,100,00 in the market price of the Kaart, one cash, 15,000, three credit cards, and one resident registration certificate.
B. On August 15, 2015, at around 17:10 on August 15, 2015, the Defendant: (a) cut off a wall of KRW 100,000,000 in a single-fluor, cash, and the market price of KRW 100,000,000 in the market price of LG 3 mobile phones, where the victim G puts off the cell car with a single eye in a single eye, and sells shopping.
C. On August 28, 2015, at around 21:00, the Defendant: (a) cut off the wallets containing one copy of “I”; (b) cash 20,000 won; (c) driver’s license; (d) credit cards; and (e) physical card, respectively, in shopping car in which the victim J puts the wall on the shopping car, and sells one eye, she gets off the wall.
Accordingly, the defendant habitually stolen another person's property over three occasions.
2. On August 28, 2015, the Defendant violated the Fraud and Specialized Credit Financial Business Act: (a) purchased “K” on the first floor of the I building located in H in Jung-gu Seoul Metropolitan Government; and (b) purchased stones equivalent to KRW 203,500 at the market price; and (c) stolen L, which caused the said store, as set forth in paragraph (1).
