A defendant shall be punished by imprisonment for a term of one year and two months.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Reasons
Punishment of the crime
The defendant is not a person handling narcotics, and the defendant shall not possess, use, transport, administer, sell, deliver, receive, or deliver psychotropic drugs, a psychotropic drug, a psychotropic drug, (hereinafter referred to as "clopon").
1. Purchasing philophones;
A. On April 2012, the Defendant conspired with C to purchase and sell phiphonephones, the Defendant purchased approximately KRW 2 gramphones from E on the street side of the Gui-si D, Gui-si, approximately 1:00,00,000, on the first half of April 2012.
B. On April 20, 2012, the Defendant, along with C, remitted KRW 3 million to the Agricultural Cooperative Account in the name of F used by E, and purchased phiphones by means of receiving approximately 5 g of phiphones sent from an express bus terminal in Chuncheon Macheon-si, on April 20, 2012.
C. On June 5, 2012, the Defendant, along with C, remitted KRW 3 million to the said account used by E, and purchased philopon by means of receiving approximately five gram of philopon, sent from the express bus terminal in Switzerland-si, Chuncheon on June 5, 2012, around 12:30.
On August 17, 2012, the Defendant, along with C, remitted KRW 3 million to the above account used by E, and purchased the philopon by means of receiving approximately five gram of the philopon, sent from the express bus terminal in Chuncheon-si, Macheon-si, on August 17, 2012.
2. Sale of philophones to G;
A. On April 16, 2012, around 21:10 on April 16, 2012, the Defendant sold 100,000 won of a single-use injection device for G containing approximately 0.2g of phiphonephones to G in front of the Chuncheon H restaurant.
B. On June 8, 2012, around 23:45, the Defendant sold to G a disposable injection machine for approximately KRW 0.2g of philopon at the International Telecom room in Chuncheon-si, Chuncheon-si.
C. On August 2012, 2012, around 20:00, the Defendant sold to G a disposable injection device with approximately KRW 0.2g of philopon from the street front of the JJ of Chuncheon. D.
